When do I need a formal hearing?
If you have more than one DUI arrest and at least one conviction, you will need to have a formal administrative hearing with the Secretary of State to clear up your license. If you live in the State of Illinois, you will be required to have a formal administrative hearing with the Illinois Secretary of State, in order to obtain either a restricted driving permit or full reinstatement of your driver’s license. If you live outside the State of Illinois, you can petition for full clearance or full reinstatement of your driving privileges at the formal hearing so that the Secretary of State will lift the national driver database hold on your license, and you can then obtain your license in your home state where you reside.

We will be with you for your entire hearing and normally ask you 99% of the questions at the hearing – we make sure to prepare you for each question so that you have, the entire hearing memorized BEFORE you even have your hearing. The reason we prepare so much is because there are two other people at your hearing – the Secretary of State lawyer and the Administrative Hearing judge. The attorney and the judge are there to scrutinize your testimony to make sure that it fits their computerized model, and they also judge your credibility.

We have found that three steps make for the perfect hearing result:

Step 1: Once you retain John W Callahan Ltd., we immediately obtain all records that the Secretary of State can use against you at your hearing. We obtain the Sworn Reports from every DUI in Illinois., and we request the PDPS (Problem Driver Pointer System) records from the National Drivers Database so that we know exactly how many DUIs are on your record AND we know exactly what dates those DUI arrests and convictions happened. This process normally takes about 2 weeks.

Step 2: Once we have all your records from the Secretary of State’s office in Springfield and when we have your PDPS reports, we typically refer you to a licensed Illinois Alcohol Evaluator who will review the Sworn Reports and DUI conviction dates. The evaluator will then typically create an alcohol evaluation with a through drinking and drug usage history and assign you a risk classification anywhere from Minimal Risk to High-Risk Dependent in remission depending on the number of DUI arrest and convictions you have.

Step 3: Once we have the records and the treatment documents, the best firm for getting your license back in Illinois creates what we call a license reinstatement worksheet. This worksheet is about 14-18 pages long and contains almost every single question you will be asked at your formal administrative hearing. If you can memorize the worksheet and keep your answers consistent with what is contained in the worksheet, you will have at least a 97% chance of success for getting either cleared up with full reinstatement or granted for a restricted driving permit.

Then we wait about 45-60 days for the answer and order granting your license reinstatement.

UPDATE – REMOTE HEARINGS – in 2022, the license reinstatement law firm of John W Callahan was involved in an experimental program with the Illinois Secretary of State allowing people seeking their driver’s license reinstatement to have a remote and virtual hearing without the need to appear in person or even in the State of Illinois. Our success rate has been incredible at getting people their licenses back through the virtual hearing process.
